Concerning the use of the Website, these Terms and Conditions constitute a legally binding agreement between the doctors whether personally or on behalf of an entity, hospitals or patients (both parties referred as “customers”, “you” or “your”) and Meindoc GmbH(“Meindoc”), incorporated and organized under the laws of the Federal Republic of Germany, having its registered office at Riebeckstraße 28, Leipzig, Saxony 04317 and registered under number HRB 37913 (“we”, “us” or “our”).
Please carefully read these Terms and Conditions before using this Website. By accessing this Website, you agree that you have read carefully, understood, and agreed to these Terms and Conditions. If you do not agree with all these Terms and Conditions, you are prohibited from using the Website and you must discontinue use immediately.
1. Scope
The services offered by Meindoc at our Website allows customer to get 3D models from medical scans such as standard CT and MRI scans. These 3D models are used to enhance the surgical planning of the patient. The enhanced surgical planning reduces the risk of complications and overall improves the surgical outcomes.
2. Intellectual property
Any information contained in this Website is subject to copyright including any text, art, graphics, design, logos, button icons, pictures, audio clips, videos, program, publication, product, process, software, technology, know-how, or idea described in, or related to is the property of Meindoc, its members, partners, software suppliers, content providers and are not licensed to you hereunder.
3. Meindoc Agreements
By using our Website, you may enter into a several other agreements with Meindoc. You may need to agree with our Cookies Policy, our Privacy Statement, and in case you open an account with us, with the Terms of Use. All these agreements and notices and other agreements you may enter into, or notices you may be provided with, in relation to the use of this Website are intended to be consistent with each other and should be read and interpreted together
4. User Registration
To use our services, you may be required to register on our Website and after which you shall be allocated to a personal account. You are fully responsible and accept the responsibility to maintain the confidentiality of your account and password. Additionally, you agree to take the responsibility for all the activities that occur under your account or password.
5. Pricing
To use our services, you may be required to pay a fee. The fees on the “Pricing” section published on the Website apply.
6. The right of withdrawal
In case of monthly subscription for the services provided by Meindoc, you may be granted a right of withdrawal within 2 weeks after from the start of subscription.
7. Termination
Meindoc reserves the right to terminate your account and access to our services in the event that i) you fail to timely pay any fees owed by you to Meindoc in connection to the use of Meindoc services, ii) you engage in any illegal or fraudulent activities with respect to your use of and/or access to the Meindoc Services or iii) the situation deems fit and appropriate for such a response. Termination shall include: removal of access to all offerings within the Meindoc services; deletion of your password and all related information, files and content associated with or inside your account (or any part thereof); and barring of further use of our services.
8. Liability
Customer claims for compensation are excluded. In no event shall Meindoc be liable for any direct, special, punitive, indirect, incidental, or consequential damages. In no event shall Meindoc be liable for any other damages, including but not limited to personal injury, wrongful death, loss of use, loss of profits, interruption of service, or loss of data, whether in any action in warranty, contract, tort (including but not limited to negligence or fundamental breach), or otherwise, arising out of or in any way connected with the use of, or the inability to use, this Website or any service offered through this Website or any material or information contained in or accessed through this Website, even if an authorized representative of Meindoc has advised of the likelihood or possibility of the same. In no event is Meindoc liable for any damages caused by your or any third party’s acts or omissions. In the event of a breach of fundamental contractual obligations, Meindoc is only liable for the contract-typical, foreseeable damage if this was caused by simple negligence, and shall not liable if customer’s claims for damages are based on injury to life, body or health. The provisions of the Product Liability Act remain unaffected.
9. Data processing
As part of providing services, Meindoc collects customer data. We comply with the regulation of the German Federal Data Protection Act, Telemedia Act, GDPR. Without your consent, we will not use your personal data for advertising, market, or research purposes. Any use of private medical data to enhance Meindoc service shall be used in strict confidentiality and will be anonymized. At anytime, you will be able to view and request the data saved under your account and you may request any change if required. 10. Change of the Terms and Conditions
These Terms and Conditions are subject to change. Meindoc reserves the right to change the Terms and Conditions at any time and for any reason. For any significant changes you will be notified via email or at this page of the Website. You can object the changed terms and conditions at any time. In such a case, Meindoc reserves the right to terminate the agreement. Furthermore, by continuing using this Website, you agree to be bound by any such change, and therefore, you are required to visit this page periodically and print the latest version of the Terms and Conditions.

Meindoc attempts to ensure that all information provided in this Website is accurate and reliable. However, the Website might contain a typographical error, inaccuracies, and/or omissions. We reserve the full right to correct those typographical errors, inaccuracies, and omissions and to change and/or update the information on the Website, without any prior notice.
12. Jurisdiction
The laws of Federal Republic of Germany shall exclusively govern all disputes and all other proceedings arising out of the connection and the content of this Website.
The Court of Leipzig shall have exclusive jurisdiction over all disputes and all other proceedings related to the content and the connection to this Website.
13. The condition of use
The customers are required to upload a standard CT or MRI scan from a government licenzed(approved) radiology center to use our 3D model services.
Meindoc shall use its services to provide the most accurate 3D model of the uploaded CT or MRI scan. The 3D model shall include only the depiction as comprehended from the uploaded scan and it shall not have any additional depiction. Meindoc services do not make final clinical or other decisions and are not a substitute for competent, properly trained and knowledgeable staff who bring professional judgment and analysis to the information presented by our Services. Therefore, Meindoc shall not be responsible for any misdiagnosis, misinterpretation or incorrect information provided by the treating doctor.
You are solely responsible for verifying the accuracy of all patient information and determining the data necessary for you to make medical and diagnostic decisions, as well as for complying with all laws, regulations and licensing requirements applicable to your delivery of healthcare services.
You are responsible for maintaining the confidentiality of your account, as well for all activities that occur under your or account. You shall immediately notify Meindoc if you become aware of any unauthorized use of your account or any other breach of security. Meindoc shall not be held liable for any loss or damage arising from your failure to comply with this Section.
14. Notice
Any query or notice in respect of the legal relationship between you and Meindoc shall be addressed to the legal department of Meindoc at legal@meindoc.eu.
15. Miscellaneous
We do not guarantee an uninterrupted and complete availability of our services according to the current state of technology. Meindoc shall not be held liable for a continuous error free provision of our services. If such interruptions arise due to scheduled or unscheduled maintenance and/or updates, we shall use reasonable commercial efforts to make the interruption as short as possible. Depending on the operating system installed and the network connection of the device used to access our services, the scope, functions and display of our services may vary/restricted. This remains beyond the scope of Meindoc and we shall not be held liable.
Meindoc shall not be responsible for the data security of the browser through which Meindoc services are accessed and the risk of data loss when data is transmitted over the Internet.
These Terms and Conditions shall be deemed to be concluded by the Customer and Meindoc, even if the services are received by the Customer free of charge. Customer shall not access our services unless our Terms and Conditions are accepted.
If any part of this Terms and Conditions of Meindoc services shall be determined to be invalid, illegal or unenforceable by any valid act of any legislature or by any regulation duly promulgated, or declared null and void by any court of competent jurisdiction, then such part shall be reformed, if possible, to conform to the law and, and in any event, the remaining parts of these Terms and Conditions shall be fully effective and operative insofar as reasonably possible.
